Terms and Conditions

4. These conditions apply to all offers, orders and agreements of Ergomax.
    Deviations are only valid if there is a written agreement.
5. Ergomax always has the authority and the right to change these conditions.
6. The conditions which can be read on the website of Ergomax are available for everyone.

 
Offers

 7. All online offers on the website of Ergomax are subject to change. Ergomax reserves the right at
      all times to withdraw an offer.

Warranty and cooling-off period

 8. If you are not satisfied with products Ergomax sold to you can return the items within 10 days   
     after delivery and only after a written confirmation. Products that are returned should be in a
     good condition, undamaged and  with the safety seal intact. The value of the returned items  will   
     be reimbursed after being received. Returned items must be returned carriage paid.

Prices and conditions

9.   All prices are quoted in euros and include VAT but exclude delivery.
      Delivery charges are clearly indicated before placing an order.
10. Payment must be made in advance by transferring the amount owed on the account of Ergomax.   
      Bank details are listed on the website and invoice.
11. After placing an order through the website you will receive an email confirming the order on the
       email address account you listed when the order was placed.
12. If no payment is received your order will not be shipped. If after 72 hours, after placing the order,
       the amount due is not received we will send a one-time reminder by email.

Deliveries

13.  Deliveries under the general conditions are for within the Netherlands as well as international
       orders.
14.  Ergomax will ship your order once the amount due is received on our bank account.
15.  All goods delivered to a retailer remain the property of Ergomax, until all amounts that the   
       retailer owes Ergomax are paid.
 16. The risks during transport of the goods ordered from Ergomax will be for Ergomax. At the time of

       delivery, or the moment which could be reasonably be regarded as delivery, the risk of the     
       transfer’s to the purchaser, subjected to the liabilities that can not legally be excluded by
       Ergomax.

Force Majeure

17. Ergomax is not obliged to perform any obligations if prevented from doing so due to a    
      circumstance which is not due to her fault, either under law, legal act or traffic related. These
      circumstances include a business  interference, failure in internet connections, transportation
      delays, strikes and not or not timely deliveries by suppliers.

Complaints

 18. The customer should notify  complaints to Ergomax by phone, email or letter. Ergomax will  
        handle this complaint as soon as possible and will try to resolve the complaint with the
        customer.

Data Protection

19.  Personal information entered by the customer in case of an order will be included in a file. This
       information will be used to process  the order of the customer.
20.  Personal  information provided to Ergomax for receiving mailings will not be sold or let to third  
       parties. If you want your email address to be erased, please e-mail to one of the email addresses
       listed on the website.
21.  Data and information processing will occur in accordance with applicable laws and regulations.

Intellectual property

 22. The intellectual property of the Ergomax website, including website design, text and images rests
        with Ergomax. Copying  and / or processing thereof is not permitted without written consent of
        Ergomax.

Applicable law

 23.  All offers and agreements of Ergomax are according to Dutch law. Disputes will be submitted to
        the legal court in Arnhem.
